Abstract
|
Background. The article examines the problems of legal regulation of using the tools of temporary administration and suspension of legal acts in a state of emergency. The relevance of this study stems from the potential demand for a state of emergency, the need for adequate legal regulation of relevant social relations and changes in a number of priorities in the state and legal policy of modern Russia. The aim of the study is to legally systematize the rules governing the procedure for temporary administration and suspension of legal acts in a state of emergency and to identify the ways of improving legislation and law enforcement practice. Materials and methods. The author uses the methodology of theoretical-legal, constitutional-legal and administrative-legal research, which is due to the specific features of the stated topic. The logical-legal analysis is used to the greatest extent; the methods of comparative law and legal forecasting are also applied. The primary material for the study is a set of legal acts that regulate these social relations. Results. The author substantiates the point of view that the main algorithms of actions involving temporary administration and suspension of legal acts in the constituent entities of the Russian Federation and municipalities should be described at the level of federal constitutional law. The legislator has a public legal obligation to plan in advance the appropriate actions of the head of state in extraordinary circumstances, so that when a state of emergency is introduced, the President of the Russian Federation can “choose” one of several models of actions that are provided for and described in detail by law, or, based on his right of constitutional discretion, use other models, which are provided for by law, but are not described in detail. Conclusions. Extraordinary circumstances may give rise to appropriate constitutional grounds for using such an extraordinary form of normative control as suspension of legal acts of territorial executive bodies by decisions of higher executive and administrative bodies. However, these measures should be proportionate and adequate, be under effective subsequent judicial control, during which, in an adversarial jurisdictional procedure, the proportionality and adequacy of the relevant prompt measures of public legal intervention derogating from the general rules of delimitation of competence should, if necessary, be justified and proven in the constitutional system of division of powers.
